Regulatory Background
On December 1, 2015, the United States Environmental Protection Agency (EPA) finalized and published in the Federal Register the updated rule for New Source Performance Standards (NSPS) for Petroleum Refineries (Subparts J & Ja) and the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Petroleum Refineries (Subparts CC and UUU).
The new rules will require petroleum refinery owners and operators to implement many changes over the next couple of years.
One of these changes is the introduction of mandatory continuous fenceline monitoring for benzene. This rule is being implemented to account for and monitor fugitive emissions from sources such as leaking equipment and wastewater treatment. The air concentration limit set forth by this continuous monitoring is 9 µg/m3. Any exceedance of this limit will trigger corrective action(s) to be completed by the facility.

Program Requirements
- One year's worth of data must be obtained by February 1, 2019.
- New methods EPA 325a and 325b sorbent tube sampling will require a 14-day change-out schedule.
- Near-field sources (NFS) may be claimed if monitoring indicates upwind sources.
- Quarterly reporting must be completed through EPA's online Central Data Exchange.
- Siting of monitors will be determined by proscribed methods, based on facility layout, at a minimum of 2,000 feet apart.
- Based on the first two years' results, tiered reduction of sampling may be available if all sample results are below 0.9 µg/m3 at the sample location.
