The Texas Commission on Environmental Quality's (TCEQ's) General Permit (TXR050000) to discharge under the Texas Pollutant Discharge Elimination System (TPDES) expired on August 14, 2016 and the new Multi-Sector General Permit (MSGP) went into effect. Industrial facilities required to have a stormwater pollution prevention plan (SWPPP), i.e., facilities with stormwater discharges associated with industrial activity as defined in 40 CFR §122.26(b)(14), will need to revise their SWPPPs within 90 days to be compliant with the new MSGP.
Significant changes may include the following:
- New Benchmark Monitoring Requirements dependent on the facility Standard Industrial Code (SIC) code
- TCEQ 2016 MSGP renewal and Discharge Monitoring Report (DMR) moving to 100 percent electronic submittal
- Impaired Receiving Waters and Total Maximum Daily Load requirements
- Decreases to the required numerical effluent limits for facility specific SIC and Sector-specific designations (the designation of specific primary industrial activity that occurs at the facility as defined in the MSGP)
- Aboveground storage tank exposure clarification resulting in coverage under the MSGP
- 90 day period after August 14, 2016, to update existing SWPPPs to meet new MSGP requirements
